UK border scheme could be illegal
(UKPA) – 0001 18th December 2009
A flagship Government scheme aimed at tracking all passenger movements into and out of the UK is likely to be ruled illegal, a committee of MPs has warned.
The £1.2 billion e-Borders programme will fall foul of EU rules and should be put on hold in advance of a legal ruling, the Home Affairs Select Committee said.
EU countries must allow free movement of each others' citizens as long as they hold a passport. But the scheme forces passengers to provide detailed personal information before they can travel.
Ministers have pressed ahead with the scheme despite lacking a ruling on its legality from the European Commission, the report says. The MPs conclude e-Borders breaches free movement rules and may also fall foul of data protection laws.
