Intra-EU immigration database 'illegal'

Friday, 18, Dec 2009 12:01

By Emmeline Saunders

A database being set up to gather information about all travellers entering and leaving the country will be illegal under EU law, MPs have warned.

A European Union member state cannot ask for more details other than those on a passport or other identity document except in exceptional circumstances.

But the UK Border Agency (UKBA) is imposing "expensive requirements on the private transport sector" without ensuring all the components of the e-borders programme are lawful, the Home Affairs Committee said.

Chairman Keith Vaz said it was "a very disappointing oversight" that "what the programme requires" will be illegal under the EU Treaty.
