Any proposals to include additional data controllers within scope will follow consultation with the persons concerned.
The Government are separately considering the arguments that have been made in favour of amending the Bill to extend further the assessment notice scheme to cover a broader range of data controllers, including those in the private sector."

The Parliamentary Under-Secretary of State for Transport (Paul Clark): It is almost a year since the Department received the independent report on personnel security in the transport industry by Stephen Boys Smith. Much work has been done since then and I can now give the House an update. [...]

We have consulted on the introduction of a mandatory requirement for overseas criminal record checks and I am announcing today that such checks will become mandatory for all new staff in posts which are subject to counter-terrorism checks. The necessary regulatory changes will be made, mode by mode starting with aviation where it will become a requirement as of 31 August 2009.

On identity we have been working with colleagues at CPNI and the UK Borders Agency (UKBA) to promulgate best practice guidance on verifying documents. We are supporting the work of the Identity and Passport Service in the delivery of improved identity services, including the roll-out of national identity cards. Stephen Boys Smith concluded that UK identity cards are a useful addition to identity assurance, and we support the decision of the Home Secretary that the objective of better identity assurance can be delivered without the need to make ID cards mandatory for airside workers. [...]


[ Interesting to see here that ID cards are classed as "useful addition" rather than being assigned the dizzying heights of gold-plated "necessity". ]

The Secretary of State for Transport (Lord Adonis): The Data Protection Act 1998 does not permit or prevent the passing on of personal data. Instead the Act provides a framework in which data may be used. Information held on the Driver and Vehicle Licensing Agency's vehicle record may be disclosed to third parties other than the police in a number of circumstances. Disclosure in these circumstances is therefore in accordance with the Act.
[ So there you have it. Information is not "passed on", it is "disclosed in accordance with the DPA". ]

There's been some all-departments ones about databases, but these have all produced some fairly non-useful answers, generally pointing as either the department's Information Asset Register or a reference to their registration with the ICO.

Mr. MacShane: To ask the Secretary of State for the Home Department if he will make available to hon. Members on request a provisional identity card document to enable passport-free travel to and from other EU member states. [284693]
Mr. Woolas: From autumn 2009, we will issue voluntary identity cards valid for travel in Europe to airside workers at Manchester and London City airports and to British citizens aged 16 and over resident in Greater Manchester at a fee of £30.
We intend then to extend the rollout of identity cards to the rest of the North West in the new year and from 2012 we will start to issue identity cards in high volumes alongside passports, offering everyone the choice of being issued with an identity card or a passport or both documents.

[ A number of questions relating to databases holding personal information came back with responses that indicate that for those departments, these 'databases' are limited to what I would describe as 'obvious administrative', e.g. correspondence ]

HmOff, DNA Databases [20 July 2009] Column 911W
- investigation/disciplinary/dismissal wrt inappropriate use of data, last five years [276825], one, not DNA-related
- data losses/inadvertend releases [276826], Feb 2009 data sent to incorrect fax numbers
- whether data or samples have been released to commercial or research organisations [283446], table of requests given, only companies mentioned are "Cellmark Forensic Services" and "LGC Forensics"
- retention of fingerprints [283525], indefinitely for recordable offences, and see also proposed retention policy in recent DNA consultation
- how people who were matched and then arrest but not subsequently charged [285950], refers to prev response 30 June 2009, Official Report, column 165W [ without checking, guessing 'info not available' or some such ]

HmOff, Identity Cards [20 July 2009] Column 927W
- how many fake national ID cards found so far [285940], none [ the national identity scheme has not yet started and no national identity cards have as yet been issued. biometric visas etc only. pay attention at the back there! ]
- how many cards recalled/withdrawn dur to errors [285941], none [ ditto ]
Chris Grayling: To ask the Secretary of State for the Home Department how many records checks have been made against the national identity card database by (a) police forces and (b) other agencies in each month since the introduction of the national identity card scheme. [285943]
Alan Johnson: The National Identity Register, which will hold the identity information of everyone issued with a national identity card, will not begin operation until later this year when we start to issue voluntary ID cards to airside workers at Manchester and London city airports as well as to British citizens living in the Greater Manchester area.
There have, therefore not yet been any checks made on the National Identity Register.

Mr. Coaker: In July 2007 Becta issued guidance on the use of biometric technology in schools. This guidance was supported by complementary guidance from the Information Commissioner's Office. The Becta guidance made it clear that while consent is not required for all processing of personal data under the Data Protection Act, schools should normally involve pupils and parents in their decisions to use biometric technologies, as is the case with other decisions made during the school life of children.
The Becta guidance also makes it clear that schools must follow the Data Protection Act in regards to the retention and storage of personal data. In accordance with the Act, schools must ensure all personal data is processed fairly and lawfully, for limited purposes, in line with individuals' rights and not held for longer than necessary. Additionally, schools need to issue a fair processing notice (FPN) to parents summarising the information held about their child or children, why it is held, and the third parties to whom it may be passed on.
