there is NO legal requriement that your son get a valid passport to satisfy his employer, or anyone else for that matter. the gudeline clearly state that an employer has to PROVE they checked during interview that a prospective employee is eligible to work in the uk and as others have mentioned,this falls into 2 groups of id documents.
now heres the sticky part in your sons case
An employer has to provide this,ONLY when being audited so when you sons employer say the ukba has said his birth certificate isnt ok, there talkin horse sh*t as they have only either a) contacted the ukba and asked for guidelines (in which case the extract argument come in,but this is simply some creton on the other end of the phone who has no idea that a birth cert is ok) b) his employer is just being an ass and wants a passport and nothing else c) being scottish myself i know the ukba and home office accept birth certificates as i have a british passport which you cant get without a bloody birth certificate scottish,english,welsh or otherwise (tell your son to stick that in hoffmans coupon)
tell your son to refuse any further meeting with anyone until he has secured and independent person to sit in on the interviews,as this manager has already broken rules and laws,and your son is quite within his legal rights to do this, if they refuse to allow anyone in,tell him to remind them that he is entitled to refuse a meeting of anything to do with his employment without an independent witness present, if they take him in for something unrelated and start to discuss employment issue halfway through, he is entitled to ask them to stop and for a independent person to enter the meeting,or that the meeting be posponed if a person is not avaiable, if they refuse he can state " this meeting is now terminated as you have breached my employment rights" in a clear and poilte manner and walk out,and they cannot do anything to him!
your birth certificate,and national insurance number are more than adequte to prove who you are in the uk, any country of the uk

I don't think it's inappropriate for a new employer to ask for some form of photo ID, whether it is just a school card or a signed letter with photo from former teachers. A simple way to commit ID fraud used to involve obtaining the birth certificate of a dead child born around the same time as you, learning a few facts about that person and then applying for a passport or driving licence from the other end of the country. Ideally you would then move abroad. Who knows how many people in our midst have done this to escape a shameful past.

Quick question, If someone doesn't have a work permit, or visa, or passport or practically nothing that would really allow them to work, what happens if they are found out? Also, what are people in this situation supposed to live on? What are people that have been granted access into the country but not full citizenship(not allowed to work) supposed to do with their lives here?

I have just worked at a festival over the weekend, it was my 8th time; I was emailed by the production team to say that they could process my payment unless I had a valid UK passport, they also stressed that it was employment law; I checked this out and it isn't entirely correct. Where in law does it say a UK citizen MUST be in reciept of a valid UK passport; NO WHERE. What appears to have happened is the State has put the frighteners on companies so that they react with edicts that are incorrect. I explained to the production team that if what they said was true regarding employment law, i have been working illegally for the last year, which is obviously tosh. This is par for the course for how the state see's it's citizens; as the enemy; haven't you notice recently how the public have just had to accept, wage freezes, huge price rises, when I first worked at the festival we got paid cash, with deductions taken out, now my payments have to go through the banks, without my consent; banks are private companies and appear to have a monopoly on our cash. Simply put the State is saying it can do what it likes and there can be no questioning or challenging it, all we get is to vote for the next party to do us over

my employer has asked for mine. They also asked for it last year and the year before when i started. i dont understand why i need to take it in every year. clearly my nationality does not change. And because i never took it in they sent me home because apparently i can not work until i take it in.

If permanent members of staff ‘must’ provide birth certificates or passports, but not temporary staff, how is that right? The people who may well have worked at a place for years are being targeted, yet temporary staff members have to ‘prove’ nothing! How does that make any sense?!

hi just a quick one, i am an EEU citizen, i was turned down for work because i havent got my passport, i lost it and have aplied for a replacement wich im waiting for to cum thru, but what i have got is a p45, a copy of my passport, and a copy of my birth certif wich is translated in english and has got the original stamps which i had to pay for, a copy from the home office back in 2006 with my residents card, and a water bill, and my previous wage slips, oh and jobseekers stuff with my national insurance number, and my own bank account, i have live and schooled and worked for ten years now and havent even got a foreign accent so can anyone tell me is that enough ID or what im really sorry for saying this but most people really dont know how to do there job this to you hr mangers all you know what to do is walk in a office talk shit all day sit on you arses and not pay attention and the big one getting the wages messed up a monkey could do your jobs better try once in a while exercise your brain and not think about with wot you gona scuff ur face in and if your not sure about the person having the rights to work contact the home office im sure in the end you would be helping you country out from the illegal ones

Interesting you should mention the Home Office! They kindly let me know that although an employer can ask to see passports/copies, it is up to an employee if they wish to comply or not.

It would be interesting to know what their 'reason' was!

You DO NOT have to provide these gits with a passport or copy of same. However, as a minimum you must present a FULL, note FULL, birth certificate. That's all the law demands. So if you've only got a short birth cert, get yourself a long one (£7 or £12 - can't remember exactly) and give 'em that. Tell these buggers that you don't have a passport!

Hi!
I am a Swedish citizen working in the UK. Over the year I have worked here my passport has gotten scanned 3 times!! And today the asked yet again to scan it and told me they have to scan ALL of it, alls stamps back and front cover and they need to do it annually to comply with immigration laws. This to me sounds completely bonkers and very, very discriminating. I have proved my EU citizenship, I have a right to live and work here I do not have an expiring VISA, that they need to check (unless Sweden or UK leaves the EU) and I got a NI. I find it offensive that they want to monitor where I go on vacation etc. I also asked what was the criteria to get these annual checks. Do I have to have a UK passport to not have to get asked to hand away very sensitive information? Is permanent residency enough? And they didn't give me an answer, just told me it was the law that they have to provide it.
