 Post subject: Legal age for CRB checks?
PostPosted: Fri, 19 Mar 2010 21:39:44 +0000
My wife (who works in a Comprehensive school) was asked today to be a referee on a form for one of her 15yo girl pupils. It was a CRB Check form.

Apparently, the girl turns 16 in June-ish, belongs to a dance club, is applying for her Dance Instructor's qualification, & is sometimes asked to "stay in the room with" younger children.

Apart from being morally reprehensible, is it legal to expect a minor to have a complete CRB check form?

BTW, neither my wife or I know whether it was an Enhanced CRB check, or otherwise, but my wife assures me it was the same form she was asked to complete when applying for her current position as a teaching Head of Department.

The minimum age for a CRB check is actually 10 - presumably on the grounds that is the age of criminal responsibility. I have struggled to find a reference to this on the CRB site but there are a number of references (mostly from sports related organisations such as the FA e.g. http://www.surreyfa.com/NR/rdonlyres/BB330A92.../CRB_FAQs.doc and http://www.thefa.com/TheFA/WhatWeDo/FootballSafe/2009/CRBFAQ230709.aspx#top

Teaching of children is a regulated activity and so is likely to require an enhanced CRB.

http://www.crb.homeoffice.gov.uk/faqs/top_10.aspx

Quote:
Regulated activity is defined as:

* Activity involving contact with children or vulnerable adults and is of a specified nature (e.g. teaching, training, care, supervision, advice, medical treatment or in certain circumstances transport) on a frequent, intensive and/or overnight basis;
* Activity involving contact with children or vulnerable adults in a specified place (e.g. schools, care homes etc), frequently or intensively;
* Fostering and childcare;
* Certain specified positions of responsibility (e.g. school governor, director of children's services, director of adult social services, trustees of certain charities)

These positions are set out in the Safeguarding Vulnerable Groups Act 2006.

Good day, I wanna thank you for asking that question because I am also curious if that is legal in that case? Thanks for those who will answer. :)

It certainly used to be 10 (there are various FAQs e.g from the FA that discuss this). Also, this response to a parliamentary question is revealing:

There is an interesting breakdown of the number of applications made by people aged 15 and under between January and December 2010. The total number of applicants was 7,801, the vast majority of whom—5,436—were aged between 15 and 15 years 11 months, with only 13 applicants aged 10 to 11 years.
